Privacy Policy

This policy explains how PT Vinotica Lestari Cemerlang (“Vinotica“, “we“) processes your personal data when you visit vinotica.biz, fill in a form, or contact us by WhatsApp, phone or email, in accordance with Law No. 27 of 2022 on Personal Data Protection (the “PDP Law“) and related regulations.

4.1 Who we are

For data collected through this site, Vinotica is the Personal Data Controller (Pengendali Data Pribadi).

This policy does not apply to CCTV footage, access data or biometric data processed by systems we install at client sites. For that data, our client is the Personal Data Controller, and processing follows the client’s policies.

4.2 Data we collect

• Form data: name, company/institution, WhatsApp/phone number, work email, the solution you are interested in and the problem you describe; for the Loading Dock Loss Audit, the numbers you enter in the calculator and the resulting estimate; for checklist downloads, which checklist you requested; plus a consent record (date/time, language version and checkbox choices).
• WhatsApp, email and phone: number and profile name, conversation content, and any files you send.
• Technical data: IP address, browser and device type, pages visited, and cookie data. Analytics cookies are only active if you consent.

We do not request specific personal data (data pribadi yang bersifat spesifik, e.g. biometric, health or personal financial data) through this site. Please do not send customer data, CCTV footage or other people’s personal data through the form or WhatsApp.

4.3 Purposes of processing

1. Responding to requests for consultations, demos or quotations, and contacting you about those requests.
2. Sending you the Loading Dock Loss Audit report or the checklist you requested and, only if you tick the separate follow-up box, contacting you by email about that request.
3. Preparing and carrying out quotations or agreements with your company.
4. Sending product information and event invitations, only if you have consented.
5. Keeping the site secure and preventing spam or misuse.
6. Understanding site usage in aggregate to improve content, if you consent to analytics cookies.
7. Complying with legal obligations.

4.4 Legal basis

In line with Article 20 of the PDP Law, we process data on the basis of: your consent (consultation, report and checklist forms; follow-up on a report or checklist request; marketing information; analytics cookies); fulfilling your request before entering into, or in connection with, an agreement (consultation and quotation follow-up); legitimate interests (site security and spam prevention); and legal obligations. You can withdraw consent at any time; withdrawal does not affect processing carried out before it.

4.5 Retention

• Consultation requests that do not lead to a business relationship: kept for no more than 24 months after the last communication, then deleted or anonymized.
• Report and checklist requests (including calculator inputs and the estimate you sent) that do not lead to a business relationship: kept for no more than 24 months after the last communication, then deleted or anonymized. Calculator numbers you do not send are processed only in your browser and are not stored by us.
• If a business relationship follows: kept for the duration of the relationship and afterwards for as long as regulations require (e.g. corporate and tax records).
• Analytics data: follows the analytics tool’s retention setting (maximum 14 months).
• Marketing consent data: until you withdraw your consent.

4.6 Sharing and processors

We do not sell your personal data. Data is only shared with:

• Vinotica’s internal team handling your request.
• Service providers acting as Personal Data Processors (Prosesor Data Pribadi) that support us: our website host (Rumahweb, servers in Indonesia); Google (Google Workspace for email, Google Analytics 4 if you consent, and Google reCAPTCHA if used); Cloudflare (Turnstile, if used); and WhatsApp/Meta for WhatsApp conversations.
• Professional advisers (e.g. legal counsel or auditors) bound by confidentiality.
• Competent authorities, where required by law.

4.7 Cross-border transfers (outside Indonesia)

Some of the providers above (e.g. Google, Meta/WhatsApp, Cloudflare) may process data on servers outside Indonesia. We use providers that apply adequate data protection and carry out transfers in accordance with the PDP Law.

4.8 Security

We apply reasonable technical and organizational measures, such as HTTPS connections, restricted internal access and password-protected accounts. No system is completely risk-free. If a personal data protection failure occurs, we will notify you and the relevant authority as required by the PDP Law.

4.9 Your rights

As a Personal Data Subject under the PDP Law, you have the right to:

• obtain information about the processing of your data;
• access and obtain a copy of your data;
• correct or update inaccurate data;
• request deletion or destruction of your data;
• withdraw consent;
• suspend or restrict processing;
• object to decisions based solely on automated processing (this site does not make such decisions);
• obtain and/or use your data in a commonly used format; and
• file an objection or complaint, and claim compensation in accordance with the regulations.

Send requests to customer.service@vinotica.biz. We may ask you to verify your identity and will respond within the period set by law. To stop receiving marketing information, reply “STOP” on WhatsApp or click the unsubscribe link in the email.

4.10 Children

This site is intended for business and institutional customers, not for children. We do not knowingly collect children’s data.

4.11 Cookies

We use necessary cookies so the site and form work securely (including anti-spam), and analytics cookies (Google Analytics 4) only if you consent through the cookie banner. You can change your choice at any time with the “Cookie Settings” link in the footer, or delete cookies in your browser settings.

4.12 Changes to this policy

We may update this policy. The latest version and its effective date are always available on this page. Material changes will be clearly marked.
